China Film Huateng (Beijing) Film and Television Culture Co., Ltd. believes that the film has many similarities with its own works in terms of plot and other aspects, constituting copyright infringement, so it sued the film's director and producer to the court for 50 million yuan in compensation. On November 11, the Beijing Intellectual Property Court announced that it had accepted the case. The plaintiff, China Film Huateng (Beijing) Film and Television Culture Co., Ltd., believes that "Nezha: The Devil Child Comes into the World" has a lot of similarities with its work "Five-Dimensional Memory" in terms of character design, storyline and production elements, and infringes its adaptation rights, reproduction rights and distribution rights. The plaintiff also claimed that on August 22, 2019, a press conference was held to publicly explain the above matters and release a "Lawyer's Statement". None of the defendants responded positively, but the plaintiff and the main creators have been subjected to online violence and defamation that continues to this day. The defendants have made huge profits from the infringement, but the plaintiff has to bear huge public pressure and rights protection costs. Therefore, the plaintiff requests that the screenwriter, director and producer of "Nezha" immediately stop the infringement, publish a statement to eliminate the impact, jointly compensate for economic losses of 50 million yuan, and bear reasonable expenses of 1 million yuan. The Beijing Intellectual Property Court has accepted the case and the case is under further trial. In fact, "Five-Dimensional Memory" has also been accused of plagiarism. Previously, Weibo user @宋蚊子321 accused "Five-Dimensional Memory" of plagiarizing his work. Recently, he revealed on Weibo that he has been busy collecting evidence of plagiarism recently. However, after consultation, he could not afford the high lawyer fees, so he did not continue to defend his rights. |
